Terms & Conditions

I) Identification of Parties

These terms and conditions, which may be updated periodically, are between Yoga with Perumal and any of its affiliates and licensees, collectively referred to as YwP. The person partaking in an event sponsored by YwP is hereafter referred to as the PARTICIPANT. YwP and PARTICIPANT are sometimes individually called a "PARTY" and collectively called the "PARTIES."


II) Definitions

  1. Event – Any yoga retreat, public weekly yoga group class, yoga workshop, private to semi-private yoga lesson, and seminar that a participant is reserved into or inquiring about.
  2. Group Leader – PARTICIPANT that is organizing a Yoga with Perumal event on behalf of more than him or herself. Any group leader agreeing to these terms and prices on behalf of a group is conditional on having authorization from the entire group and is required to forward these terms to such a group.


III) Payment Terms of Yoga Retreats, Private Lessons, and Workshops

  1. Deposit - 50% - 80% of the total payment is required upon confirmation of booking. The exact amount is determined upon reservation if it is not already confirmed on the retreat website page. The deposit is non-refundable. If it is not stated as non-refundable during the reservation process, then it follows the following terms. Payment of the deposit commences the reservation and the obligation of PARTICIPANT to pay the remaining balance or final payment according to the terms of this agreement. *PARTICIPANT payments above 50% of total without defining the deposit amount automatically calculate the deposit to be 50% of total.
  2. Final Payment - 100% payment is required two (2) months before the retreat start date and the first private, group, or workshop lesson.
  3. Sometimes upon reservation, we determine that the remaining balance shall be paid directly on the arrival date to the venue. This requires the final payment paid to the venue with only exceptions in cases of a Force Majeure.


Public Group Classes Quarterly Discounted Hours

Discounted price hours saving 20% on private lesson rates during lunch hours. A minimum of two weekly 1 or 1.5-hour afternoon classes scheduled between Mondays through Thursdays 12:00 - 14:00 is required. Reservations must be a minimum of 8 weeks and should ideally commence immediately after summer, winter, and spring holidays.

IV) Scheduling

  1. All events agreed upon in advance of more than 7 days from the yoga schedule start date must be reconfirmed by the participant 24 hours in advance of the first session.
  2. Class time begins upon the arrival of the yoga teacher into the practice area. Any talking discussion or questions during the scheduled event are counted as part of the lesson.
  3. All yoga retreat lessons are an average of 90 minutes. Classes may run longer than 90 minutes at a time depending on the ability of the group or individual, considered under the strict discretion of the teacher.
  4. Attempt to start other activities such as massages should begin 15 minutes after the expected end time of the lesson.
  5. Yoga retreat schedules are not mandatory for retreat participants to attend.
  6. Yoga retreat session start and end times are decided by the sole discretion of the teacher 24 hours before the retreat. This is based on the time of the year in relation to sunrise and sunset, current seasonal conditions, and teacher reservations. Set retreat schedules may only change during the retreat 24 hours before that scheduled change time again under the discretion of the teacher.
  7. Reserving as a group of 10 or more may allow schedules to be set when the deposit payment is made. After that, any changes of event schedules are followed according to the discretion of the teacher.
  8. All yoga retreat classes are ideally held outdoors. For rain and outdoor temperatures below 18 degrees Celsius or 65 degrees Fahrenheit, a yoga retreat class will automatically be moved indoors.


V) Booking Terms

For all YwP promoted events, including Yoga Retreats, Holidays, Private Lessons, and Workshops:

  1. A PARTICIPANT signing the booking form on behalf of other PARTICIPANTS is conditional upon having authorization from all parties attending.
  2. After receipt of full payment, any automatic online receipt forwarded by PayPal or any other online system constitutes a binding contract according to the terms outlined in this agreement.
  3. The designated venue is authorized to charge the total on the credit card of the participant. Invoicing via the venue may incur 20% VAT.
  4. All retreats require a minimum of 2 PARTICIPANTS for 2 lessons per day. A single PARTICIPANT during a retreat will receive 1 lesson a day. A single retreat participant may purchase a second lesson per day for a 33% discount from the posted private lesson prices.
  5. YwP makes no guarantees for a minimum or maximum number of PARTICIPANTS for any event. It is not in the ability to guarantee the number of attendees at an event due to possibilities of last-minute cancellations and reservations. Events such as yoga retreats are not always exclusive to YwP alone, and therefore additional participants may attend class from a venue guest list that did not reserve into a yoga retreat.
  6. A single PARTICIPANT at a Yoga with Perumal retreat may reserve an additional second lesson a day during the retreat period at a 33% discount from the existing private lesson price. The terms of private lesson reservations apply upon reservation.
  7. Cancellations of Yoga Retreats, Private Lessons, and Workshops


Grace Period

a) Any Cancellation = 100% Loss of Deposit b) 4 Weeks before the start date = 100% Loss of Final Payment

All refunds are subject to a 30-60 day period for refunds to be processed. Refunds are minus all bank charges incurred by both PARTIES.


VII) Notices

In the event a Participant has any complaint, then he/she will not discuss this with any third party and shall notify the manager as soon as possible. YwP accepts no liability for loss, damage, injury, or illnesses which may be received during the customer's stay or traveling to and from YwP.


VIII) Release

  1. YwP, its officials, directors, and employees expressly disclaim any and all responsibility for any incidental charges, liability, loss, or risk, injuries, or any other damages, personal or otherwise, which may be or are incurred as a consequence, directly or indirectly, of the actions or negligence of PARTICIPANT or any other third party during the PARTICIPANT'S attendance at any YwP events. The customer shall keep all YwP fixtures, fittings, furniture, and effects in clean and good condition and shall replace any articles that are destroyed or missing with articles of a similar kind and of equal value.
  2. A PARTICIPANT attending any YwP event, ranging from yoga holidays, yoga retreats, studio group or private classes, and any outdoor yoga classes, including the use of premises where the event takes place, shall be at the PARTICIPANT'S own risk. YwP cannot accept any responsibility for the loss or damage of personal possessions or valuables of the customer.
  3. It is prohibited for the Participants to engage in any illegal or improper behavior, including, but not limited to, drunkenness, use of illegal substances, and disturbing the peace. Steps taken by participants to incite other retreat participants or non-retreat guests against the retreat program or teacher in any way will result in dismissal from the retreat program. Removal from the premises of participants at the discretion of YwP is enforceable. YwP and participating venue members reserve the right to take any action that is deemed necessary to enforce this prohibition without any reimbursement to the dismissed participants.
  4. A PARTICIPANT who decides not to partake in the total execution of a program for any reason will be responsible for all expenses incurred by YwP up to the date of the PARTICIPANT'S departure along with the penalties imposed by the ticket issuing airline and the transportation back to the airport of origin.
  5. All lessons are geared towards general wellness. All PARTICIPANTS attending that have psychological and medical problems and/or under the care of a doctor or using any psychiatric medication need to inform YwP of such matters. We do not work with pregnant women and acute cases or those who suffer from communicative disease or skin problems.
  6. YwP and any authorized officials reserve the right to terminate the participation of a PARTICIPANT in any event if the PARTICIPANT incurs in negligent, improper, or disruptive behavior. PARTICIPANT agrees that YwP will not be held responsible for paying for any of the expenses incurred by the PARTICIPANT before and/or after the culmination of his/her participation.
  7. Unless stated otherwise, all transfer charges incurred by the PARTICIPANT must be paid by the PARTICIPANT.
  8. Alcohol is not included in the packages.


IX) Updates

These terms may be updated from time to time, and it is the sole responsibility of the PARTICIPANT to review the updates.


X) Cancellation of Yoga Retreat Lessons

a) Canceled yoga retreat lessons by PARTICIPANTS are not exchangeable with other services such as massages and hammams.

b) Canceled yoga retreat lessons by YwP will be offered in exchange for other services of equal or lesser value of 30 euros per person per retreat lesson. If the exchange is not accepted by PARTICIPANT, then 30 euros per person per retreat lesson will be refunded.


XI) Third-Party Reservations

PARTICIPANTS accept that reservations inquired through third parties, from travel agencies, online agencies, online portals, and websites for yoga retreats or group and private lesson activities, will have any of their terms superseded by this agreement, www.yogawithperumal.tv website, and any brochure forwarded by YwP.


XII) Transfers & Travel

Airport pickup and drop-off information must be provided no less than 24 hours before the required pickup and drop-off times. If the latter condition is not met, then any yoga retreat packages including airport pickup and drop-off as a complimentary service will become chargeable at the standard rate. If the service is already chargeable, then there may be an additional 33% markup added. Pickup and drop off may be diverted to any other part of Marrakech that is the equal distance to the Marrakech airport from the agreed-upon venue. Transfers & Travel for YwP + 1 is included in all transfers to and from the airport and retreat venue.


XIII) Force Majeure

“Force Majeure” means any event or condition, not existing as of the date of this agreement and not reasonably within the control of either party, which prevents in whole or in material part YwP's performance of any of its obligations hereunder or which renders the performance of such obligations so difficult or costly as to make such performance commercially unreasonable. Without limiting the foregoing, the following, without limitation, will constitute events or conditions of Force Majeure: acts of state or governmental action, riots, disturbance, war, acts of terrorism, strikes, labor slowdowns, prolonged shortage of energy supplies, epidemics, disease, fire, flood, hurricane, typhoon, earthquake, and explosion.


YwP will provide written notice to Participant of an event of Force Majeure affecting YwP's obligations hereunder and will be released, without any liability on its part, from the performance of its obligations under this agreement to the extent that its performance of such obligations is prevented by the event of Force Majeure. Such notice may include a description of the nature of the event of Force Majeure, its cause, and, to the extent known, its likely consequences.


In the event of a Force Majeure, we offer the possibility of a voucher for your deposit. The voucher is usable only once for the equal value within the original venue. Your voucher will be valid for 1 year from the date of cancellation so long as the retreat and teacher are available. We will endeavor to meet every possibility to cooperate. The Participant is responsible for checking the availability of YwP and the venue via written email communications to initiate the voucher.


XIV) Website Usage

Any user of the website has to be 18 years of age or older and agrees to be entirely financially responsible for all charges and other fees arising from the use of the website. YwP accepts no responsibility for keeping the website up to date and will not be liable for any loss due to its failure to do so. We are not responsible for the contents of any links displayed on our website.


XV) Travel Details

It is the customer’s responsibility to check the reservation and ensure that the particulars contained therein are correct. It is the customer’s responsibility to ensure that he/she has all the relevant travel documentation and arrives at the airport on time. We recommend that all customers have adequate travel, cancellation, and medical insurance for the duration of the trip.


XVI) Healthcare

The customer must comply fully with all and any health and safety regulations introduced by YwP. The customer must ensure that he/she is medically and physically fit and able to use our facilities and participate in activities. Customers who have injuries or illnesses are advised to seek doctor’s advice when practicing yoga. YwP is not liable for any injuries to the customer in his/her use of our facilities or participation in activities. A customer must always stop and rest if he/she is feeling any pain or sickness and inform the teacher of any previous injuries.


XVII) Contractual Enforcement

If any stipulation and/or provision of these terms are determined to be illegal or unenforceable, then that determination shall not affect the validity of the remaining provisions and/or stipulations. By using our services, you expressly demonstrate that you have carefully read, understood, and accepted our Terms and Conditions and our Privacy Policy statement.


XVIII) Jurisdiction and Venue

These terms and conditions are agreed upon under the United States Court of Chancery within Delaware Court Systems or any Delaware Court having jurisdiction for all financial transactions through YwP accounts. These terms and conditions are agreed upon under the Moroccan Court Systems or any similar court having jurisdiction for all financial transactions through YwP Yoga in Morocco SARL. We also act in accordance with the EU 2016/679, alias General Data Protection Regulation by European Union.

XIX) Privacy Policy

Your privacy is important to us. This privacy policy sets out how YwP uses and protects any information that you give YwP when you use this website. YwP is committed to ensuring that your privacy is protected. Should we ask you to provide certain information by which you can be identified when using this website, then you can be assured that it will only be used in accordance with this privacy statement. YwP may change this policy from time to time by updating this page. You should check this page from time to time to ensure that you are happy with any changes. We require this information to understand your needs and provide you with a better service, and in particular for the following reasons: Internal record keeping. We may use the information to improve our products and services. We may periodically send promotional emails about special offers or other information which we think you may find interesting using the email address which you have provided. * From time to time, we may also use your information to contact you for market research purposes. We may contact you by email, phone, fax or mail. We may use the information to customize the website according to your interests. In any case, you have the chance to refuse your consent in data treatment anytime, simply contacting as with a written notice.


XIX) Independent Contractor Relationship:

The parties expressly acknowledge and agree that YwP is an independent contractor and unless stated in a written agreement YwP is not an employee, agent, partner, or joint venture of the contracting party. The subcontractor shall not be entitled to any benefits or privileges typically afforded to employees, including but not limited to, health insurance, retirement benefits, or paid time off. The subcontractor is solely responsible for reporting and paying any applicable taxes, including self-employment taxes, associated with the compensation received under this subcontract.
